TERMS AND CONDITIONS
These terms and conditions apply for purchase from our online shop. Please read them carefully before ordering products from us. In order to make a purchase you must accept these terms and conditions and by doing so you agree to all that is stated below. You need to be 18 years or older to order at our web shop, otherwise you need to have your parent’s consent. By placing an order, you confirm that you possess the legal right and ability to enter into a binding agreement with Act of Caring. Please note that it is not possible to order from this online shop if you want to order products to an address outside of EU.
actofcaring AB (Act of Caring) is a Swedish company that is subject to Swedish law including EU regulations and directives. Furthermore, Act of Caring strives to always comply with mandatory consumer protection laws and regulations where you as a consumer has your country of residence. Act of Caring cannot guarantee that these terms and conditions comply with all applicable mandatory consumer protection laws. Nothing in these terms and conditions shall exclude or limit Act of Caring’s liability with regard to any matter for which it would be unlawful for Act of Caring to limit or exclude its liability according to applicable mandatory law.
All prices in the online shop include 25 % Swedish VAT and the choices of currency is; Euro (EUR) and Swedish Krona (SEK).
The prices in the online shop do not include any payment- and shipping charges or customs duty. For more info check out our FAQ.
We reserve for any price adjustments and obvious typing errors in the online shop, in advertisements or in marketing material. When Act of Caring has an online campaign the price or offer will be valid until the product is out of stock or through the set period of time.
You can pay your purchase using the payment methods described in the online shop and under FAQ. We reserve the right to not always offer all payment methods to all customers. If you are paying by bank- or credit card the payment transaction is carried out in cooperation with our payment service provider Stripe. Click here to view Stripe’s payment terms. All products remain the property of Act of Caring until payment is made in full.
All our products are marked with a Best Before Date. Up until this date we guarantee the product will keep its quality standard. The best before date is only a recommendation, the product can be used way beyond the best before date, however e.g. function and scent may be degraded. For our personal care products, such as hand sanitisers, soaps and hand creams; after your product is opened, we recommend using it within 12 months.
Since we are using natural ingredients, they may vary from one season to another depending on weather and soil conditions. This may affect e.g. the scent experience between different batches even if we are using the same formula. We always strive to present our products correctly wherever shown. However, we can’t guarantee that the colours you see at your screen exactly are as in reality. Differences may depend upon your screen and type of device you use.
All products available for purchase are in stock if no other information is shown. If for some reason a product is out of stock when your order is due for shipping, you will be notified by email and we will refund you.
AGREEMENT & ORDER CONFIRMATION
When placing an order, an agreement is entered into between you and actofcaring AB (for further company details, see clause 15 below). When we receive an order from you, we will send an order confirmation by email. We recommend you save this since it will make it easier for you if you should need to get in contact with our Customer service, Forwarding agents etc. This is also your receipt upon purchase.
SHIPPING & DELIVERY
Prices do not include shipping and delivery costs. This will be added upon ordering in accordance with what is stated in the online shop.
Please note that restrictions in the delivery may occur. For example, we do not make any deliveries outside of EU. We are not responsible for the products when in transit. Products that are in stock are normally shipped within 1-3 working days to Sweden, and 2-5 working days to European countries.
If you have ordered a product that is temporarily out of stock you will be notified by email.
You shall, depending on the selected delivery solution, retrieve, collect or receive the package in accordance with the instructions from time to time provided by us or the freight company.
For unclaimed or non-received packages a customer who is a consumer is charged a fee equivalent to the shipping and delivery costs for returning the products.
EXCHANGES & RETURNS
If you should wish to return a product, let us know by sending an email to email@example.com within 14 days from the delivery of the product/products.
Please state your address, order number and date of order, and if you have purchased several products – which products you want to withdraw in the message. Wait for a confirmation email from us before shipping the product back to us. For a step by step info, click here.
Please note that returns will only be accepted if the products are unused and labels and original packaging are fully intact. Refunds for returned products will be made to the customer upon the return of the product. Please note that the original shipping costs will not be refunded, neither will your expenses for returning the product to us.
The right of withdrawal does not apply to sealed products which are not suitable for return due to health protection or hygiene reasons that are unsealed after delivery. When ordering a product for which the right of withdrawal does not apply, you will get clear information about this.
When exercising your right of withdrawal, you must pay the costs for the return shipping and you are responsible for the condition of the product from the time of receipt and during the return shipping. We recommend that you send the product well packaged and in its original box and/or packaging. The product shall be returned within 14 days from the date that we received your notification stating that you want to exercise your right of withdrawal. Returns shall be made to us according to the methods and procedures specified on our website.
When you exercise your right of withdrawal, we will reimburse you for the returned product. We have the right to deduct a sum correspondent to the diminished value of the product compared to the original value. This only applies if and to the extent you are liable for any diminished value of the product resulting from the handling of it other than what is necessary to establish the nature, characteristics and functioning of the product.
We will promptly reimburse the payments; at the latest within 14 days from the date we received your notification stating that you want to exercise your right of withdrawal. However, we will delay the reimbursement until we have received the product, or you have showed that the product has been returned.
Reimbursement will be made to you by the same payment method chosen by you unless otherwise agreed or there is any hindrance to such reimbursement. Shipping fees are not reimbursed.
If a product is defective due to manufacturing or delivery issues or if we have delivered the wrong product, of course you have the right to return the product to us.
If you wish to lodge a complaint regarding an ordered product you must contact us as soon as possible after discovering the defect.
Please send an e-mail to; firstname.lastname@example.org. and describe what has happened as well as add a photo of the damaged product and outer package, together with your web order number.
When we have received a complaint of a product and established that the complaint is valid in accordance with applicable legislation, we will primarily replace the product. We pay for return shipping of approved complaints.
We reserve the right to deny a complaint if it turns out that the product is not defective according to applicable legislation.
Events outside Act of Caring´s control, which are not reasonably foreseeable, shall be considered force majeure, meaning that Act of Caring is released from its obligations to fulfil contractual agreements. Example of such events are, but not limited to; government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.
USE OF INFORMATION, VISUALS ETC.
The information on our website/online shop is protected by, among others, intellectual property and marketing legislation. This means that trademarks, trade names, product names, images and graphics, design, layout and information on products, services and other content may not be copied or used without the prior written consent of Act of Caring or its licensors. We may take legal actions against any unauthorized use without further notice.
APPLICABLE LAW & DISPUTE RESOLUTION
In cases of any dispute, we will follow the submitted recommendations from the Swedish National Board for Consumer Disputes.
The National Board for Consumer Disputes may be accessed either via the website www.arn.se or address Box 174, 101 23 Stockholm, Sweden.
